1. Scope

2. Milestone-Based Payment Structure
premiumlayoutworks operates on a milestone-based payment system. Projects are divided into defined phases, each with an agreed-upon deliverable and payment schedule. Refund eligibility is assessed based on the project milestone reached at the time of the refund request:
- Before Work Begins: Full refund of any advance payment, minus administrative processing fees of 5%.
- During Active Development: Refund is calculated proportionally based on completed milestones. Payments for completed and approved milestones are non-refundable.
- Post-Delivery: Once a deliverable has been formally accepted and approved by the client, the corresponding milestone payment is non-refundable.
3. Conditions for Refund
A refund may be requested under the following conditions:
- The service was not delivered within the agreed timeframe due to circumstances solely attributable to premiumlayoutworks.
- The delivered work materially deviates from the project specification and cannot be remedied through reasonable revisions (up to 3 rounds of revision per milestone are included).
- Cancellation of the project before any work has commenced.
4. Refund Process
To request a refund, you must submit a written request to [email protected] with your project reference number and a detailed explanation of the grounds for the refund. We will acknowledge receipt within 2 business days and provide a resolution within 14 business days. Approved refunds will be processed using the original payment method within 30 days of approval.
5. Non-Refundable Items
The following are not eligible for refund:
- Third-party costs incurred on behalf of the client (domain registrations, hosting fees, stock assets, API subscriptions).
- Work completed and accepted under a change request approved by both parties.
- Services rendered free of charge or as part of a promotional offer.
6. EU Consumer Rights
Nothing in this Refund Policy affects your statutory rights under EU consumer protection legislation. If you are a consumer located within the European Union, you may have additional rights under applicable distance selling regulations.
Terms of Service

1. Agreement to Terms
By accessing or using the services provided by premiumlayoutworks, located at C. Luis Marin 8, Madrid, Madrid, Espana, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services. These terms constitute a legally binding agreement between you (the Client) and premiumlayoutworks (the Provider).
2. Scope of Services
premiumlayoutworks provides web design, development, branding, SEO optimisation, content strategy, cloud deployment, and related digital services. The specific scope, deliverables, timelines, and pricing for each engagement are defined in a separate project proposal or statement of work (SOW) agreed upon by both parties prior to commencement of work.
3. Project Engagement and Milestones
All projects follow a structured engagement model:
- Discovery Phase: Initial consultation, requirements gathering, and project scoping.
- Blueprint Phase: Design concepts, wireframes, and technical architecture documentation.
- Build Phase: Active development and implementation of agreed specifications.
- Validation Phase: Quality assurance testing, client review, and approval cycles.
- Deployment Phase: Launch, handover, and post-launch support period.
Each milestone requires formal client approval before proceeding to the next phase. Approval may be provided in writing via email or through our designated project management channels.
4. Payment Terms
Payment schedules are defined in each project proposal. Standard terms require:
- A non-refundable deposit of 30% upon project initiation.
- Progress payments aligned with milestone completion.
- Final payment due within 14 days of project completion and formal acceptance.
Late payments incur a statutory interest charge of 8% per annum plus a fixed compensation of EUR 40, in accordance with EU Directive 2011/7/EU on late payments in commercial transactions. All quoted prices are exclusive of VAT (IVA), which will be applied at the prevailing Spanish rate.
5. Intellectual Property
Upon receipt of full payment, premiumlayoutworks assigns to the Client all intellectual property rights in the final delivered work product, including source code, design assets, copywriting, and branding materials. premiumlayoutworks retains the right to display completed work in its portfolio and marketing materials unless explicitly prohibited by written agreement.
Third-party assets (stock images, fonts, frameworks, libraries) remain subject to their respective licence terms. premiumlayoutworks will inform the Client of any third-party licence restrictions applicable to the project deliverables.
6. Confidentiality
Both parties agree to maintain the confidentiality of all proprietary information shared during the course of the engagement. This obligation survives the termination of the agreement for a period of 24 months. Confidential information includes, but is not limited to, business strategies, technical specifications, client lists, and financial data.
7. Limitation of Liability
To the maximum extent permitted by applicable law, premiumlayoutworks shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the services provided. Our total aggregate liability under any engagement shall not exceed the total fees paid by the Client for the specific project giving rise to the claim.
premiumlayoutworks does not warrant that the services will be error-free, uninterrupted, or completely secure. While we employ industry-standard security practices, the Client acknowledges that no digital system is impervious to all threats.
8. Termination
Either party may terminate the agreement with 14 days' written notice. In the event of termination:
- The Client will pay for all work completed up to the date of termination.
- premiumlayoutworks will deliver all completed work product and materials in its possession.
- All confidentiality obligations remain in force as outlined in Section 6.
9. Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of Spain and, where applicable, the European Union. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain, without prejudice to the consumer's right to bring proceedings in their country of residence under EU Regulation 1215/2012.
10. Amendments
premiumlayoutworks reserves the right to amend these Terms of Service at any time. Material changes will be communicated to active clients via email at least 14 days before taking effect. Continued use of our services following any amendment constitutes acceptance of the revised terms.
